7 Activity must comply with approved environment plan
The operator of an activity commits an offence if the operator carries out the activity in a way that is contrary to —
the environment plan for the activity; or
any limitation or condition applying to the activity under regulation 11(4)(b).
Penalty: a fine of $10 000.
Subregulation (1) does not apply to the operator if the operator has the written consent of the Minister to carry out the activity in that way.
The Minister must not give a consent under subregulation (2) unless there are reasonable grounds for believing that the way in which the activity is to be carried out will not result in —
the occurrence of any significant new environmental impact or environmental risk; or
the occurrence of a significant increase in any existing environmental impact or environmental risk.
