37 Requirement for, and notification of, operator
The instrument holder for an activity must ensure that, at all times, there is an operator of the activity.
Penalty: a fine of $10 000.
The operator of an activity is the person responsible to the instrument holder for the overall management and operation of the activity.
The instrument holder must notify the Minister, in writing, of the contact details of the operator of the activity before the first submission in relation to the activity is made under Part 2.
Penalty: a fine of $10 000.
The instrument holder must notify the Minister, in writing, of any change of operator of the activity —
if it is practicable to do so — at least 28 days before the change takes effect; or
otherwise — at the earliest practicable opportunity.
Penalty: a fine of $10 000.
Nothing in this regulation affects any duty or responsibility of the instrument holder, under the Act, in relation to an activity carried out under the instrument.
