44 Environmental management plans submitted before commencement day
If, immediately before commencement day, the operator of an activity had submitted an environmental management plan for the activity to the Minister, but the Minister had not accepted or refused to accept the plan before that day —
(a)
the environmental management plan is taken to be submitted under regulation 9 as an environment plan for the activity; and
(b)
the Minister must give the operator a reasonable opportunity to modify and resubmit the environmental management plan to meet the requirements for environment plans under these regulations.
