Secretary may vary or revoke late hour entry declaration
90 Secretary may vary or revoke late hour entry declaration
The Secretary may, in accordance with this section, vary or revoke a late hour entry declaration.
The Secretary must give written notice of a proposed variation or revocation of a late hour entry declaration—
to each licensee whose licensed premises are subject to the declaration, and
to the local consent authority for those premises.
Any such licensee or the local consent authority may, within 21 days after the notice is given to the licensee or the authority (as the case requires), make a written submission to the Secretary in relation to the proposed variation or revocation.
The Secretary must, before deciding whether to vary or revoke a late hour entry declaration, take into consideration any submissions received by the Secretary under subsection (3).
