77 Payments of royalty

For the Act, section 291(1)(a), in the case of minerals other than coal, a royalty is payable on or before 31 July in each year in respect of the period of 12 months ending on the last preceding 30 June, unless subclause (3) applies.
In the case of a person by whom, in respect of the last preceding period of 12 months that ended on 30 June, an amount of royalty greater than $50,000 was payable in respect of minerals (other than coal), royalty on minerals (other than coal) recovered during the succeeding period of 12 months is payable—
on or before 31 October, in respect of the period of 3 months ending on 30 September, and
on or before 31 January, in respect of the period of 3 months ending on 31 December, and
on or before 30 April, in respect of the period of 3 months ending on 31 March, and
on or before 31 July, in respect of the period of 3 months ending on 30 June.
In the case of coal, royalty payable at the base rate is payable within 21 days after the beginning of each month.
Despite another provision of this clause, a royalty is payable in relation to a mining lease—
on the day on which a return must be lodged before an application is lodged for registration of a transfer of the mining lease in accordance with clause 76(2A), and
for the period beginning immediately after the last day on which a royalty was payable under the mining lease before the day referred to in paragraph (a) and ending on that day.
