75 Section 3A inserted
After section 3 of the Principal Act, the following section is inserted in Part I:
3A. Compliance with resource management and planning system objectives In exercising any powers or performing any functions under this Act in relation to any reserved land, a person must have regard to the resource management and planning system objectives. In the case of reserved land for which there is a management plan, if there is any inconsistency between the resource management and planning system objectives and the provisions of the management plan, the provisions of the management plan prevail. In the case of reserved land for which there is not a management plan, if there is any inconsistency between the resource management and planning system objectives and the management objectives for the class of that reserved land or the purposes for which that land was reserved, the latter objectives and the purposes prevail.
The amendment effected by this section has been incorporated into the authorised version of the National Parks and Wildlife Act 1970.
