10.04 Alternative arrangements for giving evidence
This Rule applies if a party wishes to use alternative arrangements for giving evidence referred to in section 69(1)(a) or (b) of the Act.
A party may apply to use alternative arrangements for giving evidence by notifying the Court in writing before the hearing.
A notification under subrule (2) must set out—
the reason the witness needs alternative arrangements for giving evidence; and
the alternative arrangements sought.
Despite subrule (2), if the party has not notified the Court, the Court may direct that alternative arrangements be made if they are available on the day of hearing at that venue of the Court.
