7.01 Attendance by subpoena

(1)

A party may by subpoena require a person to attend at the hearing of the proceeding for the purpose of giving evidence or of producing any document or thing or for both purposes.

(2)

A subpoena must be in accordance with Form 1.

(3)

If under the Act a party requires leave of the Court to require a person to attend, the subpoena must—

(a)

specify that leave has been granted; and

(b)

be accompanied by a copy of the order, or extract of the order, granting that leave.

(4)

An order by subpoena for the attendance of a person in a proceeding is taken to be made on the signing of the subpoena by a registrar.
