12.01 Venue of Court

(1)

An application under the Act must be made by filing the application at the proper venue of the Court.

(2)

Filing must be effected by—

(a)

filing in the office of the Court at that venue; or

(b)

facsimile transmission or other electronic communication to the Magistrates' Court of Victoria After Hours Service in the case of an application made under section 20 or 44 of the Act.

(3)

In the case of a family violence safety notice—

(a)

the location for the first mention must be the proper venue of the Court; and

(b)

the copy of the form or safety notice form must be filed—

(i)

in the office of the Court at that venue if issued during business hours; or

(ii)

by facsimile transmission or other electronic communication to the Magistrates' Court of Victoria After Hours Service if issued after business hours.

Note

Proper venue is defined in section 3(1) of the Magistrates' Court Act 1989.
