12.09 Default by claimant
(1)
If—
(a)
a claimant has been given due notice of the hearing of an application for relief by way of interpleader and does not attend on the hearing; or
(b)
a claimant does not comply with an order made on such an application—
the Court may order that the claimant and all persons claiming under the claimant be barred from prosecuting the claimant's claim against the applicant and all persons claiming under the applicant.
(2)
An order under paragraph (1) must not affect the rights of the claimants as between themselves.
