17.01 Partners
(1)
If 2 or more persons carry on business as partners within Victoria, a proceeding may be commenced by or against them in the name of the firm (if any) of which they were partners when the cause of action accrued.
(2)
Paragraph (1) applies if partners sue or are sued by—
(a)
any partner of the same firm;
(b)
partners of another firm, and any partner of the one firm is a partner of the other.
