8.02 Late giving of notice of defence

A defendant may give notice of defence at any time after the service of a complaint, but, except by leave of the Court, notice of defence must not be given if—

(a)

the plaintiff has obtained an order under Part 1 of Order 21; or

(b)

by order of the Court, the defendant's notice of defence has been struck out.
