33AG Review of CEO’s decisions for dog supply approvals
In this regulation —
person affected, in relation to a decision of the CEO, means —
in the case of a decision referred to in section 38R(1)(a) — the applicant for the dog supply approval; or
in the case of a decision referred to in section 38R(1)(b) or (c) — the holder of the dog supply approval to which the decision relates.
For section 38R(3), a person affected by a decision of the CEO may apply to the State Administrative Tribunal for a review of the decision.
If an application has been made under subregulation (2) for a review of a decision, the effect of the decision is suspended until the determination of the application by the State Administrative Tribunal.
Subregulation (3) does not apply if the State Administrative Tribunal orders that the effect of a decision referred to in section 38R(1)(b) or (c) should not be suspended while the review is underway.
