18C Power to authorise work
The Commissioner may authorise a person to carry out main roads works that the Commissioner is empowered to carry out under this Act or any other written law.
Works authorised under subsection (1) may be works carried out —
wholly at the other person’s expense; or
partly at the Commissioner’s expense and partly at the other person’s expense; or
on some other basis determined or approved by the Commissioner.
An authorisation under subsection (1) may be subject to conditions specified by the Commissioner.
If an authorisation under subsection (1) allows a person to carry out works in relation to a road under the care, control or management of a local government, the approval of the relevant local government is required before the person commences the works.
Subsection (4) does not apply if the works only relate to the intersection of a main road or highway with another road.
