37 Regulations
In this section —
designated place means —
a highway or main road; or
any other place that is owned by, or under the care, control and management of, the Commissioner.
The Governor may make regulations prescribing all matters that —
are required or permitted by this Act to be prescribed; or
are necessary or convenient to be prescribed for giving effect to the purposes of this Act.
Without limiting subsection (2), regulations may be made for any or all of the following purposes —
prescribing matters for or in respect of which fees may be charged under this Act and prescribing the amount of those fees (including fees for access onto highways and COA road sections);
regulating the access to, and movement of, prescribed types of vehicles on designated places;
regulating road train assembly and break down areas on designated places;
regulating the parking or standing of vehicles on designated places;
regulating the removal, storage, forfeiture and sale or other disposal of vehicles, goods and animals left on designated places;
empowering the Commissioner to —
enter into an agreement with another person relating to the removal, storage, forfeiture and sale or other disposal of vehicles, goods and animals left on any road under the care, control and management of that person; and
arrange for the removal, storage, forfeiture and sale or other disposal of vehicles, goods and animals in accordance with that agreement;
regulating activities, including works, by persons other than the Commissioner in relation to designated places;
prohibiting the construction, reconstruction or placement of anything on, over or under a designated place without the authority of the Commissioner;
providing for corrective works necessitated by an activity referred to in paragraphs (e), (f), (g) or (h);
providing for the recovery of the Commissioner’s costs in relation to a matter referred to in paragraph (d), (e), (f), (g), (h) or (i);
regulating the employment by the Commissioner of persons as cadets.
The regulations may provide that contravention of a regulation is an offence, and provide, for an offence against the regulations, a penalty not exceeding a fine of $2 000.
