460 Authorisations under medicines wholesalers licences—Act, s 20 (1) (a)

(1)

A medicines wholesalers licence authorises the licence-holder to do any of the following in relation to a medicine (the licensed medicine) stated in the licence at the premises (the licensed premises) stated in the licence:

(a)

issue a purchase order for a licensed medicine;

(b)

obtain a licensed medicine on a purchase order for sale by wholesale from the licensed premises;

(c)

possess a licensed medicine for sale by wholesale from the licensed premises;

(d)

sell a licensed medicine by wholesale (whether or not for resale) from the licensed premises to—

(i)

a person authorised to issue a purchase order for the medicine; or

(ii)

someone in another State who may obtain the medicine by wholesale under the law of the other State; or

(iii)

someone in another country who may lawfully obtain the medicine by wholesale in the other country;

Note The medicines must be sold on a purchase order in accordance with s 140 (see s 461).

(e)

unless the licensed medicine is a controlled medicine—supply the medicine in accordance with the medicines Australia code of conduct provisions for product starter packs.

(2)

However, an authorisation under subsection (1) does not apply if the licence states that it does not apply.

(3)

Also, subsection (1) (d) (iii) does not apply in relation to a licensed medicine that is a prohibited export under the Customs Act 1901 (Cwlth).
