Jurisdiction of Tribunal in relation to pre-existing consumer claims

(1)

Part 6A of this Act extends to a consumer claim arising before the commencement of that Part (except as provided by subclause (2)).

(2)

The former Act continues to apply in relation to a consumer claim the subject of an application made under section 6 of the former Act that is not finally determined.

(3)

For the purposes of this clause, an application is not finally determined if—

(a)

any period for bringing an appeal as of right against a decision in respect of the claim the subject of the application has not expired (ignoring any period that may be available by way of extension of time to appeal), or

(b)

any appeal against the decision is pending (whether or not it is an appeal brought as of right).
