43 References to qualified valuers
Subject to the regulations, a reference in any Act or regulation to a qualified valuer is taken to include a reference to a relevant valuer.
Subclause (1) does not apply in relation to a person to whom an order that is in force under this clause applies.
The Secretary may, by order published in the Gazette, direct that a person who is a relevant valuer is not to be taken to be a qualified valuer under this clause if the Secretary is satisfied that—
the person is a disqualified person (within the meaning of the Valuers Act 2003, as in force immediately before the repeal of that Act), or
the person was not eligible to be registered and was registered by mistake or as a result of any false representation concerning the person’s age or qualifications for registration, or
any circumstances prescribed by the regulations apply in relation to the person.
The Secretary may, by notice published in the Gazette, revoke an order under this clause.
