4 Secretary may decline to accept application or make direction
The Secretary may decline to accept an application for a consumer guarantee direction—
if the Secretary is of the opinion that—
the application is frivolous, vexatious, misconceived or without substance, or
the supplier concerned is bankrupt, in liquidation or under external administration, or
because of the complexity of the subject-matter of the application, the matter should be dealt with by the Tribunal, or
it would not be in the public interest to deal with the application under this Schedule, or
for any other reason prescribed by the regulations.
The Secretary may refuse to make a consumer guarantee direction—
if the Secretary is of the opinion that—
because of the complexity of the subject-matter of the application, the matter should be dealt with by the Tribunal, or
it would not be in the public interest to make the direction under this Schedule, or
it is fair and reasonable in the circumstances to do so, or
for any other reason prescribed by the regulations.
