19 Stopping certain activities in forestry areas—the Act, s 92
For the Act, section 92(2)(f) and (h), an authorised officer may direct a person to stop carrying out an activity in a forestry area if the officer believes, as a result of the weather conditions, the activity creates a risk of a fire igniting or spreading.
A person given a direction under subsection (1) is guilty of an offence if the person—
does not immediately comply with the direction, or
resumes the activity before an authorised officer permits the resumption of the activity.
Maximum penalty—20 penalty units.
This section applies despite conditions or limitations specified in a licence, forest permit, forest lease or small quantity authorisation issued or granted in relation to a forestry area.
