For the Act, Schedule 2, clause 16, the licensee for a pipeline must, at least 28 days before the licensee must give the Secretary an audit report under section 13—

appoint a person as an auditor, and

give written notice of that appointment to the Secretary.

for a corporation—250 penalty units and, for a continuing offence, a further 25 penalty units for each day the offence continues, or

for an individual—50 penalty units and, for a continuing offence, a further 5 penalty units for each day the offence continues.

A person must not be appointed as an auditor unless the person is—

independent of the licensee, and

competent to exercise the functions of an auditor.

A licensee does not commit an offence under subsection (1) if the Secretary has rejected or terminated the appointment under section 12B.
