Commissioner’s assessment of grounds for review
36 Commissioner’s assessment of grounds for review
On receiving an application for a review, the Commissioner must—
assess the grounds on which the application is purported to have been made, and
decide whether the application sets out a ground for making the application.
If the Commissioner is satisfied the application sets out a ground for making the application, the Commissioner must—
convene a review panel for the purposes of determining the application, and
refer the application to the review panel for determination.
If the Commissioner is satisfied the application does not set out a ground for making the application, the Commissioner must dismiss the application.
A decision of the Commissioner under this section is final and not subject to any further review.
