Procedure for conducting review
42 Procedure for conducting review
The procedure for conducting the review must be determined by the appointed person.
However, the review must not be conducted as a hearing that involves persons appearing before the appointed person.
The Commissioner is authorised to give the appointed person information on which the decision the subject of the review was based, including information about the integrity of the officer.
The appointed person may—
require the officer to give further information in relation to the application, and
ask the Commissioner to give information relevant to the decision the subject of the review, and
obtain expert advice in relation to a matter that is relevant to the review, and
inform themselves in any other way the appointed person thinks appropriate.
The Commissioner must, if asked by the appointed person, give the appointed person any information relevant to the decision the subject of the review.
In conducting the review, the appointed person may consider—
written information given by the officer, and
information given by the Commissioner under subsection (3), (4)(b) or (5).
