State Records Act 2000

In addition to the Director’s other functions under this Act, the Director’s functions are —

to advise government organisations on record keeping and on training their staff in record keeping and to assist in such matters; and

to advise government organisations on the preparation of and compliance with record keeping plans; and

as to those State archives in the State archives collection to which there is unrestricted access, to provide —

an information service about them; and

public access to them; and

appropriate facilities and services to enable them to be effectively used for administrative requirements and for study and research;

to create and maintain a register of all State archives, including those that are not in the State archives collection; and

to provide such advice and assistance to the Commission as the Commission requests; and

to report to the Commission about —

the operation and effectiveness of this Act; and

any breach or suspected breach of this Act by any person or State organisation.

The Director’s function under subsection (1)(f)(ii) has effect despite any duty to keep information secret that the Director has under any other written law, whether enacted before or after the commencement of this Act.

The Director may, either generally or as provided by the instrument of delegation, delegate to any person any of the Director’s functions under this Act except this power of delegation.

Performance of a function by a delegate is to be treated as performance by the Director.
