First address of registered office
12 First address of registered office
For the purposes of section 42‑15 of the new Act, if:
a transitional corporation is registered as a large corporation because of an alteration under item 10; and
no address has previously been declared under this item; and
the corporation has a place of business at an address in Australia;
the CATSI Registrar may, in writing, declare that address to be the first address of the corporation's registered office.
The address becomes the address of the corporation's registered office from:
the day specified in the declaration, being a day after the declaration is made; or
otherwise-the day the declaration is made.
Division 112 of the new Act does not apply in relation to a transitional corporation if:
the corporation is registered as a large corporation because of an alteration under item 10; and
an address has not become the address of the corporation's registered office under subitem (1).
A declaration under subitem (1) is not a legislative instrument.
This item has effect despite section 42‑15 of the new Act.
To avoid doubt, section 4 of the Acts Interpretation Act 1901 applies in relation to this item.
