39 Service—minors
(1)
Subject to subrule (2), a person serving a subpoena on a minor must serve it instead on—
(a)
the minor’s parent or guardian; or
(b)
if there is no parent or guardian, an adult who has the care of the minor or with whom the minor lives.
Editor’s note—
A minor is an individual who is under 18 years—Acts Interpretation Act 1954, schedule 1.
(2)
A person serving a subpoena on a minor who is over 16 years may serve it on the minor only if the minor—
(a)
does not have a parent or guardian; or
(b)
is not apparently in the care of an adult or does not apparently live with an adult.
