31 Assessable development—operational work for referable dams
Operational work that is the construction of a dam, or relates to a dam, is assessable development, if—
(a)
because of the work, the dam must be failure impact assessed; and
(b)
the accepted failure impact assessment for the dam states the dam has a category 1 failure impact rating or a category 2 failure impact rating.
