8 Assessable development—material change of use for an environmentally relevant activity
(1)
A material change of use of premises for an environmentally relevant activity is assessable development, if the activity is a concurrence ERA (the relevant ERA).
(2)
However, subsection (1) does not apply if—
(a)
an environmental authority to carry out a concurrence ERA has been approved for the premises; and
(b)
the relevant ERA and concurrence ERA are to be carried out under the environmental authority; and
(c)
the relevant ERA has a lower aggregate environmental score than the concurrence ERA.
