20 Payment while on long service leave

(1)

An employer must give an employee the pay to which the employee is entitled in respect of long service leave in any way and at any time that is agreed to by the employee and the employer before the start of the long service leave.

Penalty: In the case of a natural person, 12 penalty units for each day during which the offence continues;

In the case of a body corporate, 60 penalty units for each day during which the offence continues.

Note

Section 43 applies to an offence against this subsection.

(2)

If no agreement exists, an employer must give an employee the pay to which the employee is entitled in respect of long service leave in one of the following ways—

(a)

pay in full when the employee starts the long service leave;

(b)

pay at the same time and in the same manner as if the employee were not taking long service leave.

Penalty: In the case of a natural person, 12 penalty units for each day during which the offence continues;

In the case of a body corporate, 60 penalty units for each day during which the offence continues.
