41 Judicial notice

(1)

All courts must take judicial notice of—

S. 41(1)(a) amended by Nos 14/2021 s. 70(2), 35/2025 s. 80.

(a)

the signature of a person who is, or was at the time the signature purports to have been made, the Minister, the Secretary, the Commissioner of the Workforce Inspectorate Victoria or an employee to whom section 40(1) applies; and

(b)

the fact that a person referred to in paragraph (a) held the position the person purported to hold at the time the signature purports to have been made.

(2)

All courts must take judicial notice of the official seal of the Workforce Inspectorate Victoria affixed to a document and, until the contrary is proved, must presume that it was duly affixed.
