408 Inspectors may require certain persons to appear, answer questions and produce documents
An inspector may by notice in the form prescribed by the regulations —
require a co‑operative to produce to the inspector at a time and place specified in the notice specified relevant documents relating to the co‑operative; or
require a person who is involved in the activities of a co‑operative to produce to the inspector at a time and place specified in the notice specified relevant documents relating to the co‑operative; or
require a person who is involved in the activities of a co‑operative —
to attend before the inspector at a time and place specified in the notice; and
to answer any questions put to the person by the inspector relating to the promotion, formation, membership, control, transactions, dealings, business or property of the co‑operative.
A person is to be considered to be involved in the activities of a co‑operative if the person —
is or has been an officer or employee of, or an agent, financial institution, legal practitioner, auditor or other person acting in any capacity for the co‑operative; or
has relevant documents relating to the co‑operative in the person’s possession or control; or
was a party to the creation of relevant documents relating to the co‑operative.
A person is not subject to any liability as a result of complying with a requirement made or purportedly made under this section.
