422 False or misleading documents
A person must not give to the Registrar or an inspector a document containing information the person knows is false or misleading in a material particular.
Penalty for this subsection: a fine of $12 000, or imprisonment for one year, or both.
Subsection (1) does not apply to a person who, when giving the document —
tells the Registrar or inspector, to the best of the person’s ability, how it is false, misleading or incomplete; and
if the person has, or can reasonably get, the correct information, gives the correct information to the Registrar or inspector.
It is enough for a prosecution notice lodged against a person for an offence against subsection (1) to state the document was false, misleading or incomplete to the person’s knowledge without stating which.
