Declaration of targeted assessment development
4.20A Declaration of targeted assessment development
A State environmental planning policy may declare development, or a class of development, to be targeted assessment development.
For subsection (1), a State environmental planning policy may specify criteria that development, or a class of development, must meet to be targeted assessment development.
Before recommending the making of a State environmental planning policy by the Governor under this section, the Minister must take steps—
to publicise an explanation of the intended effect of the proposed policy, and
to invite the public to make written submissions to the Minister on the proposed policy within a specified period after the date on which the explanation was published, being a period of not less than 28 days, and
to consider the written submissions received by the Minister within the specified period.
Development, or a class of development, declared to be targeted assessment development may also be another type of development under this part.
Despite subsection (1), a State environmental planning policy must not declare the following development to be targeted assessment development—
development that is designated development,
development that would be designated development if section 4.10(2) did not apply.
