Application of Division

Current

This Division—

(a)

applies to development that may not be carried out except with development consent, but

(b)

does not apply to complying development.

Note.

Under this Part, the procedures by which development consent is obtained differ according to whether the development—

(a)

is or is not State significant development, and

(b)

is or is not designated development (which it may be declared to be by an environmental planning instrument or the regulations), and

(c)

is or is not integrated development (see Division 4.8).
