8.16 Appeals against failure or refusal to issue certificate under Part 6
(1)
An appeal may be made to the Court against the following decisions of a council under Part 6—
(a)
a decision to refuse to issue a construction certificate, occupation certificate, subdivision works certificate or subdivision certificate,
(b)
a decision to issue any such certificate subject to conditions.
(2)
The appeal may be made by the applicant for the certificate concerned.
(3)
An appeal may be made only within 6 months after the date on which the decision was made.
