54 Noncompliance notice
This section applies if an inspecting person—
has complied with section 52 for a stage of assessable building work; and
is not satisfied all relevant aspects of the stage have been completed and comply with the building development approval for the work.
If the inspecting person is a building certifier, the inspecting person must give the builder for the assessable building work a notice in the approved form (a noncompliance notice) stating—
the stage of the work does not comply with the building development approval; and
how the stage does not comply with the approval; and
the work required to ensure the stage complies with the approval.
If the inspecting person is a competent person (inspection), the inspecting person must give the builder and the building certifier for the assessable building work a notice—
in the approved form; and
stating—
the stage of the work does not comply with the building development approval; and
how the stage does not comply with the approval.
If the building certifier is given a notice under subsection (3) the certifier must—
if the building certifier is not satisfied the stage complies with the building development approval for the work—give the builder a noncompliance notice; or
if the building certifier is satisfied the stage complies with the building development approval for the work—give the builder a certificate of inspection for the work.
