Either:
(a)
the applicant had not turned 45 at the time of application; or
(b)
the applicant has not reached the age specified by the Minister in a labour agreement:
(i)
that is in effect; and
(ii)
to which the employer is a party; and
(iii)
under which the position to which the application relates is nominated.
