11.6 Appeal against stop work order
(1)
A person against whom a stop work order is made may appeal to the Land and Environment Court against the making of the order.
(2)
The lodging of an appeal does not, except to the extent that the Court otherwise directs in relation to the appeal, operate to stay action on the stop work order appealed against.
(3)
After hearing an appeal, the Court may—
(a)
confirm the order, or
(b)
modify or rescind the order.
(4)
In making a decision on an appeal, the Court is to have regard to the principles of ecologically sustainable development and the public interest.
