71 Entertainment conditions not to be imposed
From the commencement of this clause, an entertainment condition may not be imposed on a licence.
However, subclause (1) does not apply to—
an entertainment condition imposed in response to a disturbance complaint, or
an entertainment condition relating to adult entertainment of a sexual nature.
From the commencement of this clause, a live entertainment condition may not be imposed on a licence.
However, subclause (3) does not apply to a live entertainment condition relating to adult entertainment of a sexual nature.
To remove any doubt, this clause does not prevent an entertainment condition in force immediately before the commencement of this clause being varied or revoked.
In this clause—
entertainment condition means a condition of a licence that has the effect of limiting—
the entertainment that may be provided on licensed premises or an area adjacent to licensed premises, or
the way in which entertainment may be provided on licensed premises or an area adjacent to licensed premises.
live entertainment condition means a condition referred to in clause 70(1).
