17 Interruptions to which this Part does not apply
Sections 18 and 19 do not apply to an interruption that —
is to the supply of electricity on the South West interconnected system and —
that occurs during, or as a consequence of, an emergency operating state; or
that is occasioned by the exercise or performance of a power or duty under a written law to disconnect the supply of electricity to any premises on account of fire or other hazard or to facilitate the rescue of any person or property;
is caused by the eligible person or equipment under the eligible person’s control; or
the Minister determines should not attract a payment under this Part because it occurred in exceptional circumstances.
A determination under subsection (1)(c) is to be made by order published in the Gazette, and may be revoked or amended by the Minister in the same way.
