Requirement concerning keeping and production of records or other documents under former road transport legislation
40 Requirement concerning keeping and production of records or other documents under former road transport legislation
Any requirement under a provision of the former road transport legislation for a person (other than the Authority) to keep a record or other document for a period (the original period) that has not expired before the repeal day is taken to continue as a requirement to keep the record or other document under the corresponding provision of the new road transport legislation for the unexpired balance of the duration of the original period.
Any power conferred on a person by a provision of the new road transport legislation to require the production of a record or other document (or a copy of such a record or document) extends to a record or other document created before the repeal day that could have been required to be produced under a former corresponding provision if that provision had continued in force.
