Road Safety Act 1986

This Division applies if an inspector believes on reasonable grounds that a vehicle is in breach of a mass, dimension or load restraint limit or requirement, and the vehicle is on or in any of the following places—

any highway; or

any public place; or

in or on any premises—

occupied or owned by the Head, Transport for Victoria or by any other public authority; or

occupied by the Secretary or the Department; or

any premises that an inspector is authorised to enter under this Act; or

any other place, but only if the vehicle has entered that place as the immediate result of it being involved in an accident on or near a highway.

For the purposes of this section, an accident is an incident that involves a vehicle and that results—

in a person being killed or injured; or

in damage being caused to a vehicle, or to other property.
