Road Safety Act 1986

for the purpose of—

the following functions and activities when performed by the Secretary or a relevant person—

the administration of this Act or the regulations; or

providing information of community interest or benefit; or

a vehicle recall procedure being conducted in relation to a possible safety-related defect in a vehicle or a class of vehicles; or

research, or the compilation or analysis of statistics, conducted in the public interest, other than for publication in a form that identifies an individual or from which an individual's identity can be reasonably ascertained; or

the exercise of a power or the performance of a function under transport legislation; or

administering the accessible parking permit scheme, including—

facilitating the assessment of whether a person is entitled to be issued an accessible parking permit; and

facilitating the issue of accessible parking permits by municipal councils; and

maintaining a record of persons who have been issued an accessible parking permit; and

enabling any law enforcement agency to determine whether a person is using a valid accessible parking permit which that person is entitled to use; or

any legal proceeding—

arising out of this Act, the regulations or any other transport legislation; or

that otherwise relates to the performance of a road management function within the meaning of the Road Management Act 2004 or to damage to infrastructure within the meaning of that Act resulting from a road accident—

giving effect to an intergovernmental agreement; or

if the use or disclosure is reasonably necessary to lessen or prevent a serious threat to—

an individual's life, health, safety or welfare; or

public health, safety or welfare; or

the environment—

for the purpose of dealing with exceptional circumstances in accordance with section 90L; or

with the consent of—

the individual to whom the information relates; or

the authorised representative of that individual; or

to a not-for-profit organisation to assist the organisation—

to locate a missing person; or

to facilitate the reunion of members of a family or friends—

to a police officer to assist Victoria Police—

to locate a missing person; or

to locate the next of kin of an individual who has suffered injury or death; or

to conduct a check on the wellbeing of an individual; or

to any person for the purpose of verifying the authenticity of a digital driver licence document; or

for the purposes of one or more of the following functions and activities when undertaken by or on behalf of a law enforcement agency—

the prevention, detection, investigation, prosecution or punishment of offences of any kind;

the enforcement of laws relating to the confiscation of the proceeds of crime;

the preparation for, or conduct of, proceedings before any court or enforcement of the orders of a court;

the protection of public revenue;

the enforcement of infringement penalties (by whatever name they are known in the relevant jurisdiction); or

if the relevant information is used or disclosed in the course of using or disclosing information as authorised by Part 8.8A of the Marine Safety Act 2010; or

if the use or disclosure is otherwise required or authorised by law.
