178 Penalties applying to offences under this Division and exclusion of double jeopardy

A person who commits an offence under this Division (other than an offence under section 176) is liable to the following maximum penalties—
in the case of an offence that involves a breach of a mass limit—
if the breach is a severe risk breach—
600 penalty units, if the person is a corporation; or
120 penalty units, in any other case;
if the breach is a substantial risk breach—
300 penalty units, if the person is a corporation; or
60 penalty units, in any other case;
if the breach is a minor risk breach—
100 penalty units, if the person is a corporation; or
20 penalty units, in any other case;
in the case of an offence that involves a breach of a mass, dimension or load restraint limit or requirement other than a mass limit—
if the breach is a severe risk breach—
500 penalty units, if the person is a corporation; or
100 penalty units, in any other case;
if the breach is a substantial risk breach—
100 penalty units, if the person is a corporation; or
20 penalty units, in any other case;
if the breach is a minor risk breach—
50 penalty units, if the person is a corporation; or
10 penalty units, in any other case.
A person may be punished only once in relation to each breach of a mass, dimension or load restraint limit or requirement in relation to a vehicle.
