1 Application of amendments to pending determinations of licences
This section applies to the determination of the share component of a replacement floodplain harvesting access licence under Part 3, Division 2 if, before the date on which the amending regulation commenced, the Minister—
had complied with each applicable requirement of section 38, and
had not given written notice of the final share component to an eligible floodplain landholder under section 43(1).
Section 35, as amended by the amending regulation, applies to the determination of the share component and the Minister may revise the proposed share component under section 35(2)(b).
The Minister must give the eligible floodplain landholder written notice if the Minister determines the proposed share component to be a lesser amount under section 35(2)(b).
Notice given under subsection (3) must contain the information referred to in section 38(5)(a)–(c1).
In this section—
amending regulation means the Water Management (General) Amendment (Replacement Floodplain Harvesting Access Licenses) Regulation 2026.
