72 Work impounding water
A work—
(a)
that impounds an amount of water exceeding the harvestable rights referred to in an order under the Act, section 54 for the landholding on which the work is located, and
(b)
that is constructed before 1 January 1999, and
(c)
that is used only for—
(i)
domestic consumption or stock watering, or both, or
(ii)
a purpose that does not require the extraction of water from the work, and
(d)
that is located on, or within a catchment of, a minor stream, and
(e)
from which water is being used only on the landholding on which the dam is located.
