42 Determining authorities for works permitted under EPA Act
A determining authority is exempt in relation to the construction or use of a flood work if—
(a)
the construction or use is permitted under the Environmental Planning and Assessment Act 1979, and
Example—
The construction or use could be permitted under a development consent or an approval under the Environmental Planning and Assessment Act 1979, Division 5.1, or otherwise.
(b)
the work is located in or on an area other than an unmanaged designated high risk flood area.
