43 Landholder for works approved under EPA Act
A person is exempt in relation to the construction or use of a flood work if the following applies—
(a)
the person is not a determining authority,
(b)
the construction or use of the work is carried out under—
(i)
a development consent, or
(ii)
an approval under the Environmental Planning and Assessment Act 1979, Division 5.1,
(c)
the work is located on a landholding owned or occupied by the person—
(i)
that is located in or on an area other than an unmanaged designated high risk flood area, and
(ii)
that has a total area of 0.2ha or less.
