89 Mandatory conditions for Ministerial exemptions
For the Act, section 115A, it is a mandatory condition of an approval to which an exemption under section 88 applies in relation to a work under the approval that the approval holder must—
(a)
for an exemption granted under section 88(3)(b), (c) or (e)—not take water from a water source using the work, and
(b)
for an exemption granted under section 88(3)(d)—not take water from a water source using the work other than under a basic landholder right, and
(c)
for an exemption granted under section 88(3)(f)—
(i)
not take water from a water source using the work, and
(ii)
ensure the work cannot take water from a water source.
