102 Declaration of particular fish as regulated fish
Fish stated in column 1 of the table in schedule 2, part 2 are declared to be regulated fish.
However, the fish are regulated fish only to the extent stated in this part.
Also, the fish are not regulated fish if they are taken or possessed in a way permitted under part 4.
Fish may be regulated fish—
without any further limitation; or
only in relation to—
particular factors, particular persons or particular activities; or
a combination of particular factors, particular persons or particular activities.
Examples—
1 Billfish are regulated fish only in relation to taking or possession for trade or commerce.
2 Redclaw in quantities over 40 are regulated fish only in relation to taking or possession in particular waters.
Fish may be regulated fish in more than 1 way under this part, including, for example, in relation to more than 1 factor.
Example—
Australian bass are regulated fish in relation to number and size.
